Felony bills filed in year-old beating case
The St. Landry Parish District Attorney’s Office has filed felony bills of information against two Eunice brothers, a year after they allegedly beat a vagrant and one of them allegedly threatened him with a handgun. At the time both suspects were off-duty Eunice firemen.
Garret Daville is charged with aggravated assault with a firearm.
His brother, Ryan Daville, is charged in the bill filed in July with second-degree battery. In the year since the incident, Ryan Daville has left the department for private employment.
His arraignment was scheduled before Judge James Doherty for Aug. 7, but Daville did not appear. A summons was issued for him and his arraignment was re-scheduled for Oct. 2.
Arraignment is the formal process at which defendants plead to the charges, a plea that is almost always not guilty.
The two suspects are accused of beating David Frank while they were off-duty.
Ryan was initially also charged with being a principle to aggravated assault with a firearm and Garrett was initially also charged with second-degree battery.
They have been free on bond since their arrests.
According to police radio logs the night of the incident, a phone call was made to the police at 10:48 p.m. on Wednesday July 10, 2013 advising of a theft and that a subject tried to break into a vehicle and stole a purse in the area of City Hall.
The caller listed was Garrett Daville.
An officer responded to the call and arrived on the scene – which was on the empty lot adjacent to the police station.
According to the radio logs, the officer then walked along the side of the alley between the Central Fire Station and next-door apartments, looking for the purse. The officer indicated in the radio log that a “recovered a pocket knife and butcher knife” were taken off of the male subject – who was at that point a theft suspect. The officer also noted a broken window on a white truck parked by the fire station.
At that point the officer advised dispatch to call an ambulance for the suspect detained who was “to the point where he was unresponsive”.
Earlier, reports indicate, the Daville brothers were at The Dugout bar on South 2nd Street with their wives. Allegedly, one of the wives left her purse in a truck belonging to Ryan or Garrett. Soon after the vehicle was discovered to have been broken into.
Allegedly, the brothers went to look for the thief in the east side alley off of South 2nd Street in downtown and came upon David Frank, who was carrying a wrench in his hand.
At the time, Police Chief Ronald Dies said “somebody broke into their truck and they thought it was him. They went after him and they tackled him and that’s how it all began...they beat him up.”
Frank broke loose, ran across Park, chased on foot by Ryan Daville and in his truck by Garrett.
Frank, the warrant affidavit says, was overtaken by the pursuing brothers on the lot adjacent to the police station, sources said. They allegedly punched the victim in the face and kicked him and Garrett allegedly aimed a pistol at him. The firefighters then called police
