Trial of accused child-killer delayed again

The second-degree murder trial of a Eunice man accused of killing an infant has again been put off, this time until March 2015.
The new trial date is more than two years after Robert H. Miller, III allegedly killed 19-month-old Victoria Renee LeJeune.
Miller has been free on bond since shortly after his arrest on March 4, 2013.
His most recent trial date setting was for next month, but at a hearing this week, his attorney asked for and received another delay.
The judge in the case, 27th Dist. Judge Alonzo Harris, will be on criminal bench in December, then rotate back to criminal court in March.
According to Miller’s arrest affidavit, Deputy Mark Fontenot found the child unresponsive when he arrived at the mobile home where the girl lived with her mother, Kimberly LeJeune, who had called 911.
“Deputy Fontenot noticed numerous bruises to the infant’s face and body,” the affidavit, written by Lt. Jesse Martin, Jr., stated.
An autopsy revealed Victoria died from “acute traumatic brain injury due to blunt force injury,” Martin wrote, though the forensic pathologist found no signs the girl was injured in a fall.
Martin wrote that on Feb. 28 the girl’s mother said her daughter had no bruises until hours after her live-in boyfriend, Miller, came home from work Feb. 22, two days before Victoria died.
“Ms. LeJeune stated she saw Mr. Miller poke Victoria in the head multiple (five times at most) over the past eight weeks they have lived together,” Martin wrote. “Ms. LeJeune stated she saw Mr. Miller poke Victoria in the head multiple times (her head was forced back each time) on Feb. 22, 2013.”
Witnesses subpoenaed for the Nov. 10 hearing were Capt. Craig Ortego, Kimberly LeJeune, Adrienne Bourque of New Iberia, Nicholas Johnson of Basile and Susan Albritton of Acadia Parish.
